Terms And Conditions

Reference herein to the Customer shall be to a Company, a business partnership, individual or sole trader to which Arc Transcription and Secretarial Services (referred to as ATSS in these Terms and Conditions) directly provides its services to.

 

The parties agree to the following which covers all products and services which the Customer has purchased or ordered:


1. ORDER ACCEPTANCE

1.1 All orders are subject to acceptance by ATSS.  An order will only be deemed accepted if the Customer receives confirmation from ATSS to this effect.

 

1.2 ATSS may at its absolute discretion refuse to accept any order.

 

1.3 If the audio quality of a recording is deemed by ATSS to be of poor quality, ATSS will contact the Customer and offer a revised rate for transcription.  The order will not be deemed accepted unless the Customer agrees to this revised rate in writing.

 

2. PAYMENT FOR SERVICES

2.1 ATSS will issue an invoice on acceptance of the Customer Order in accordance with the rates published on the ATSS website unless other arrangements are made with the customer in writing.

 

2.2 Payments are due within 7 days of the date of the invoice.  Transcription or any other agreed service will not begin until payment has been received unless otherwise agreed in writing.

 

3. REFUNDS

3.1 No refund shall be applicable once transcription of any recording has commenced unless ATSS does not complete the contract or ATSS uses its discretion to refund if the Customer gives notice that they do not wish to continue with the service.

 

4. USE OF SERVICES

4.1. ATSS products and services may only be used for lawful purposes.

 

4.2 The Customer accepts that ATSS does not accept any liability to the Customer and/or its customers from any loss or damage however caused resulting from transcriptions provided by or to the Customer and/or its customers using ATSS’s services.

 

5.0 ACCURACY OF SERVICES

5.1. Any typographical errors or omissions in the documentation produced by Arc Transcription & Secretarial Services shall be corrected free of charge, provided the firm is notified of any such amendments within 48 hours of the date of submission to the client or thereafter at the sole discretion of Arc Transcription & Secretarial Services. If no notification of error or omissions is received by Arc Transcription & Secretarial Services from the client within 48 hours, then the work shall be deemed to have been accepted as accurate & complete.  The Customer agrees that it is the Customer’s responsibility to check transcription work carefully to ensure that no errors exist.

 

5.2. Arc Transcription & Secretarial Services will make every effort to accurately transcribe all dictated material provided by the client. Where dictated material provided by the client is unclear, Arc Transcription & Secretarial Services will highlight in the text provided where such instances occur.

 

6.0 CONFIDENTIALITY

6.1. All information received by Arc Transcription & Secretarial Services in voice file format, orally, written or other shall be treated as confidential. Such information will not be used for any purpose other than that agreed between Arc Transcription & Secretarial Services and the client. Furthermore, this information will not be disclosed to a third party unless written instruction to this effect has been received from the client.

 

7.0 DATA PROTECTION ACT

7.1 ATSS reserves the right to hold information relevant to the Customer in accordance with the Data Protection Act 1998.  This information will be used internally by ATSS and will be kept in the strictest of confidence.  No information held by ATSS relating to any Customers will be sold or in any way passed to a third party.

 

8.0 LEGAL AGREEMENT

8.1 These Terms and Conditions are governed by English Law and are covered by the jurisdiction of the English Courts.  If any clause of these Terms and Conditions is held to be invalid by an English Court of Law then the remaining clauses shall nevertheless remain in full force and effect.

 

8.2 ATSS and the Customer agree to renegotiate in good faith any term held invalid and to be bound by mutually agreed subsitution provision.

 

8.3 Submission of audio files to ATSS confirms acceptance of these Terms and Conditions.
